Terms and Conditions

These terms and conditions govern the use of the Invest Control service available at www.invest-control.eu and in related applications. By using the service you express your consent to them.

1. Provider

The service is operated by GS West s.r.o., company ID (IČO) 09300554, with its registered office at třída Vítězství 13/14, Hamrníky, 353 01 Mariánské Lázně, Czech Republic, registered in the Commercial Register maintained by the Krajský soud v Plzni (Regional Court in Plzeň), file no. C 39521 (hereinafter the "provider").

The provider is not a value added tax payer.

2. What the service is and what it is not

Invest Control is a tool for recording and tracking an investment portfolio. It allows you to record transactions, display current and historical asset prices, calculate dividends and tax documentation, and model scenarios in financial calculators.

The service is not investment advice. The provider is not a securities broker, an investment intermediary or an adviser under the Czech Capital Market Undertakings Act. It does not recommend buying, selling or holding specific assets, does not manage third-party assets and does not execute orders. All decisions are made solely by you at your own responsibility.

The service is not tax advice. Tax outputs are an aid, not a tax return nor an opinion of a tax adviser. You are responsible for the correctness of your own tax statements.

Market data is informative. Prices, exchange rates and corporate events come from external providers. They may be delayed, estimated, incomplete or erroneous. They are not intended for real-time trading decisions. Always verify key figures with your broker or with the issuer.

3. User account

Registration is required in order to use the service. During registration you provide an e-mail address and a username; your real name is voluntary. The details provided must be truthful and must be kept up to date.

The account is personal. You must not share your access credentials with other persons and you are responsible for all activity carried out under your account. Please report any suspected misuse of your account to us without delay at info@invest-control.eu.

The service may be used by persons over 18 years of age with full legal capacity. By registering you confirm this.

Organizations

Every account belongs to an organization. On registration, a personal organization is created automatically, in which you are the owner. An organization may have several members with different roles; the owner is responsible for their access rights and for the organization's subscription.

4. Subscription, prices and payments

The scope of features and the prices of the individual plans are set out on the Pricing page. Prices are final, the provider is not a VAT payer.

The provider reserves the right to change prices and the composition of the plans. The provider will inform you by e-mail at least 30 days in advance of any change affecting your running subscription; the new price will apply only from the following billing period. If you do not agree with the change, you may cancel the subscription before then. A change in legislation imposing on the provider an obligation to add tax to its prices (for example, an obligation to register for VAT in cross-border sales) is not considered a price change under this paragraph.

Payments are processed by the payment gateway provider Stripe. The provider has no access to your payment card number and does not store it.

Billing period means the period for which the subscription is arranged — depending on the plan chosen, one month or one year. The subscription is paid in advance for the whole billing period, on the date on which that period begins. For yearly subscriptions the provider will notify you of the upcoming payment by e-mail at least 7 days in advance.

The provider will issue a receipt for each payment and send it to your billing e-mail. Receipts are also available in the subscription management section of your account.

Trial period

A new organization may be granted a free trial period of the length stated at registration. The trial period does not require entering a payment card and no subscription is created automatically upon its expiry — you activate a paid plan yourself.

Renewal and cancellation

The subscription renews automatically at the end of each billing period until you cancel it. You may cancel it at any time in your account settings, including shortly before a renewal — what matters is the moment at which you carry out the cancellation. Cancellation takes effect at the end of the paid period: until the end of that period the service continues to run and the amount paid is not refunded; this is without prejudice to your right to withdraw from the contract under Article 5. Once it expires, the account is switched to the free mode.

Failed payment

For the duration of the subscription you are required to maintain a valid payment method with the payment gateway provider.

If a payment cannot be processed, the provider will repeatedly attempt to charge it and will notify you by e-mail. Your paid plan continues to run for a further 14 days from the day of the first unsuccessful attempt. If you settle the outstanding amount within that period, the subscription continues unchanged.

If you do not settle it, the account is switched to the free mode once that period expires, or earlier if the payment gateway provider cancels the subscription. You do not lose the data stored in the service; it remains available within the scope of the free plan.

5. Withdrawal from the contract

If you are a consumer, you have the right to withdraw from the contract within 14 days of its conclusion without giving a reason. It is sufficient to send the withdrawal by e-mail to info@invest-control.eu.

If you withdraw within the 14-day period, the provider will refund the amount paid within 14 days at the latest, using the same means by which it was received. If you used the service during that period, the provider may refund the proportionate part corresponding to the unused period.

The period runs from the conclusion of the contract, i.e. from your first subscription order. An automatic renewal for a further billing period does not create a new contract and therefore does not start a new 14-day period; you can prevent a renewal at any time by cancelling the subscription under Article 4.

The right of withdrawal does not apply to entrepreneurs.

6. Rules of use

You must not use the service in a way that would damage it or restrict other users. In particular, it is not permitted to:

  • circumvent technical restrictions, request limits or security measures;
  • download content automatically beyond ordinary use (scraping) or resell market data obtained from the service;
  • share a single account between several persons;
  • post to the community and other public parts content that is unlawful, misleading, offensive, unsolicited commercial, or that constitutes an investment recommendation or market manipulation;
  • attempt to gain access to the data of other users or organizations.

You are responsible for the content you post to the service. The provider is entitled to remove content violating these rules.

Connecting a brokerage account

The service allows a connection to an account with a supported broker by means of an access key that you generate yourself. We recommend using a read-only key. Keys are stored encrypted and serve exclusively for downloading your data. The provider does not use them to place orders or carry out any operations with your assets. You bear responsibility for the scope of the permissions you grant to the key.

7. Termination by the provider

The provider may terminate the contract even without giving a reason, with a notice period of 30 days. In such a case it will refund the proportionate part of the subscription for the unused period.

In the event of a serious breach of these terms — in particular misuse of the service, circumvention of limits, account sharing, posting unlawful content or conduct harming other users — the provider may suspend the account or terminate the contract with immediate effect and without compensation. The provider will notify you of the breach in advance and call on you to remedy it, unless the conduct is of such a nature that it does not permit any delay.

After the contract ends you have 30 days to export your data. Once that period expires, the data is deleted in the manner described in the Privacy Policy.

8. Availability and liability

The service is provided "as is". The provider strives for its continuous operation, but does not guarantee availability without interruption and is entitled to carry out outages necessary for maintenance, updates or security.

The provider is not liable for:

  • decisions you make on the basis of data from the service, nor for their financial consequences;
  • inaccuracy, delay or outage of data from external providers;
  • outages caused by third parties (hosting, payment gateway, broker) or by force majeure;
  • loss of data if you do not keep your own backup.

To the extent permitted by law, the provider's liability for damage is limited to the amount you paid for the service in the 12 months preceding the occurrence of the damage. This is without prejudice to liability for damage caused intentionally or by gross negligence, or to the statutory rights of consumers.

9. Intellectual property

The software, design, texts and databases of the service are protected by intellectual property rights and remain the provider's. By registering you acquire a non-exclusive, non-transferable right to use the service for the duration of the contract.

The data you post to the service remains yours. The provider processes it only to the extent necessary for providing the service and for the purposes described in the privacy policy.

10. Complaints and out-of-court dispute resolution

Please submit complaints about defects of the service to info@invest-control.eu. The provider will settle the complaint within 30 days at the latest.

If you are a consumer and the dispute cannot be resolved directly, you may turn to the Česká obchodní inspekce (Czech Trade Inspection Authority), Štěpánská 796/44, 110 00 Praha 1, www.coi.cz, which has subject-matter competence for the out-of-court resolution of consumer disputes.

11. Changes to the terms

The provider may amend these terms. It will inform you of any material change by e-mail or by a notice in the service at least 30 days before it takes effect. If you do not agree with the change, you may terminate the contract before the effective date; by continuing to use the service you accept the change.

The current as well as the previous wording of the terms is available on this page; the effective date and the version are stated at the end of it.

12. Governing law

The contractual relationship is governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code. The courts of the Czech Republic have jurisdiction to resolve disputes. If the user is a consumer, this arrangement is without prejudice to their rights arising from mandatory provisions of the law of the state of their habitual residence.

These terms are drawn up in the Czech, English and German languages. In the event of a conflict between the language versions, the Czech wording shall prevail.
